If you are under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use Tell-A-Pal?s website. Further, your Tell-A-Pal account (including feedback) and User ID may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind the entity to this Agreement.
Submitting referrals on Tell-A-Pal?s website is free. Tell-A-Pal does charge fees for vendors obtaining referrals through our Site and when you become a Tell-A-Pal member you have an opportunity to review and accept the fees that you will be charged. Tell-A-Pal?s Fees and Credits Policy is available and is incorporated into this Agreement by reference. Tell-A-Pal may change its Fees and Credits Policy and the fees for Tell-A-Pal?s services from time to time. Tell-A-Pal may in its sole discretion change some or all of the Services at any time. In the event that Tell-A-Pal introduces a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees associated with using Tell-A-Pal?s service and the Site and all applicable taxes. Some professions do not allow fees to be awarded based on referrals. It is the vendor?s duty to comply with any applicable law, statute, professional code of conduct, ordinance or regulation and Tell-A-Pal shall not be held responsible for any fees paid in contravention of such regulations.
Tell-A-Pal's website acts as a venue to allow anyone to submit and receive referrals, at anytime, from anywhere. Tell-A-Pal is not involved in monitoring the status of a referral or the actual transaction between vendors and customers. As a result, Tell-A-Pal has no control over the truth or accuracy of the referrals. We cannot ensure that a referred customer will actually use the vendor?s services.
You must be legally able to sell the service(s) you list on the Tell-A-Pal website. You must describe your service(s) and all terms of the service(s) on the listing page of the Tell-A-Pal website. Your listings may only include text descriptions, graphics, pictures and other content relevant to the service(s). All listed services must be listed in an appropriate category.
Without limiting any other remedies, Tell-A-Pal may suspend or terminate your account if it suspects that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Tell-A-Pal website.
The information you list on Tell-A-Pal?s website (or any services listed) and your activities on the website shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of illegal services or items; (c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any applicable law, statute, professional code of conduct, ordinance or regulation (including, but not limited to restrictions on sharing of fees, restrictions on giving referral fees, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography; (g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement or ones that you do not have a right to link to or include. Furthermore, you may not list any service on the Tell-A-Pal website (or consummate any transaction that was initiated using our Services) that, by paying to us the listing fee or the final value fee, could cause us to violate any applicable law, statute, ordinance or regulation.
Solely to enable Tell-A-Pal to use the information you supply us with, so that we are not violating any rights you might have in that information, you agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in your information, in any media now known or not currently known, with respect to your information. Tell-A-Pal will only use your information in accordance with our Privacy Policy.
